Street cleaning fees
Performance specification
The City of Beckum cleans the public streets within the enclosed local areas.
Street cleaning charges are levied to cover the costs. The owners or leaseholders of the properties which are accessed by the streets listed in the street directory are liable for the fees.
Street cleaning charges are to be levied on the owners of the plots of land accessed by the publicly cleaned street.
Plot of land within the meaning of the street cleaning law is in principle the book plot of land, i.e. the plot of land entered under its own number in the land register.
Development
For the purposes of street cleaning law, a property is developed by a public road if it can be reached - at least on foot - from the road and there is thus a reasonable economic possibility of using the property. Not only the properties directly bordering on a public road are made accessible by it, but also those properties which can be reached indirectly, e.g. via a private path or via a property in front of it, from the public road (so-called "Hinterlieger"). It is therefore appropriate to include these properties, which are not located directly on the road, in the assessment of street cleaning fees. Through this inclusion, the total costs of urban street cleaning can be distributed among more property owners, which in the end benefits all those liable for the charges. The fees for the individual are lower than would be the case if the assessment did not include the properties in the rear.
Calculation of the fees
The basis for the calculation of the street cleaning fee are:- the side of the property along the road by which the property is accessed (frontage length),
-
the type of road and
-
the number of weekly cleanings.
The respective fee rate depends on the category (type) of the street being cleaned. The street category (residential streets, pedestrian shopping streets, inner-city and inter-city streets) in turn depends on the type and traffic significance of the street to be cleaned and is defined in the street directory for the individual streets.
Front length
The street cleaning fee is assessed according to the length of the property sides along the street to be cleaned.
The frontage lengths to be taken into account are the sides which are the same as the street boundary (adjacent frontages) and which face it (facing frontages). Facing frontages are those sides and sections of the property boundary line which are equidistant or at an angle of less than 45° to the street boundary. If a side only partially borders or faces the street, the frontage lengths that would result from imaginary extensions of the street in a straight line shall be taken as a basis. No facing sides are the sides lying behind adjoining and facing frontages. Adjoining and facing frontages to be taken into account thereafter shall be added together.
If a property is accessed via a dependent public spur road or a dependent public spur road, only the side adjoining or facing the main spur shall be taken into account. Independent road parcels or garage yards which only provide access or access to the cleaned road shall not be taken into account. Where a property is served only by the turning bend of a street, the frontage calculation shall be based on the sides of the property which are parallel or at an angle of less than 45° to an imaginary straight line extension of the street. In determining the sides of the property, fractions of a metre up to and including 0.50 metres shall be rounded down and fractions over 0.50 metres shall be rounded up.
Number of weekly cleanings
The frequency of weekly cleanings depends on the degree of pollution of a street and is specified in the street directory for each street.
From the street directory, which is part of the street cleaning statutes, you can see which streets/parts of streets are cleaned by the City of Beckum or are to be cleaned by you as a resident.
Cleaning obligations of the owners
As a general rule, the cleaning and winter maintenance of the pavements (with the exception of pedestrianised shopping streets and mixed areas) is the responsibility of the owners of the properties adjacent to and accessed by the pavements.
Further details are regulated by the street cleaning and fee statutes of the City of Beckum in the currently valid version.
